Sonic Boom – ToneMaker Xtreme Scooter Sweepstakes

Official Rules

 

 

NO PURCHASE NECESSARY.  A PURCHASE OR USE OF WIRELESS SERVICE WILL NOT IMPROVE YOUR CHANCE OF WINNING. 

 

1.         How To Enter:  Via Mobile: Use your AT&T phone to log on to the “MEdia Mall” section of the main menu and follow instructions to subscribe to ToneMaker Xtreme, or navigate to www.att.com/mediamall and follow instructions to purchase and subscribe to ToneMaker Xtreme. You will receive one (1) automatic entry to the sweepstakes upon download. A subscription fee and standard data charges apply to download and use ToneMaker Xtreme.   A monthly subscription to a package that includes unlimited MEdia Net data plan is required.  You may also receive an entry into the sweepstakes for free by mailing a 3” x 5” card, including entering your name, age, address, contact phone and e-mail address to ToneMaker Xtreme Scooter Sweepstakes, P.O. Box 8022, Westport, CT 06888.  Entries will be disqualified if they contain any inappropriate material or language, including profanity.  Promotion begins 12:00:01 a.m. ET June 2, 2009, and ends 11:59:00 p.m. ET July 1, 2009 (the “promotion period”).  All electronic entries must be received by 11:59:00 p.m., July 1, 2009, when promotion ends.  All mail-in entries must be postmarked by July 1, 2009 and received by July 6, 2009.

 

2.             Participation:  Promotion is open to legal residents of the 50 United States, plus D.C., 18 years of age or older.  Employees and their immediate families (parent, child, spouse, sibling) and household members of employees of AT&T Mobility, LLC, Sonic Boom, Inc. and their respective affiliated and parent companies, advertising and promotion agencies and anyone involved in this promotion’s production, development or handling are not eligible.  This promotion is subject to all federal, state and local laws and regulations.  Void in Puerto Rico or where prohibited by law. 

 

3.         Validation:  Prize Winners will be determined randomly from among all eligible entries received on or about July 10, 2009.  All drawings to be conducted in Westport, Connecticut by The Concept Studio, LLC, an independent judging organization, whose decisions are final on all aspects of the promotion. All submissions are subject to validation by the judging organization.  By entering, you agree to be bound by these Official Rules and all decisions of the judging organization.  Prize Winners will be notified via phone and/or e-mail and may be required to sign and return, within 7 business days after delivery to his/her address, an Affidavit of Compliance with these Official Rules, a Prize Release and a Publicity Release for use of his/her name, likeness, and biographical information without further compensation unless prohibited by law.  Failure to sign and return these forms postmarked within 7 business days may result in forfeiture of prize and selection of an alternate winner.  Entry materials void if incomplete or if they contain errors.  All submissions become property of Sponsor. 


 

4.         Prize and Odds:  One (1) Grand Prize:  Kymco Sento 50 Scooter (ARV:  $1,899).  Grand Prize Scooter (“Scooter”) will be delivered with standard equipment; any upgrades and options are at the sole expense of the winner.  Color, package, factory options, and other prize specifics to be determined by Sponsor and are subject to availability. Sponsor does not make, nor in any manner is responsible or liable for any warranty, representation or guarantee, expressed or implied, in fact or in law, relative to the Scooter including but not limited to its quality, fitness for purpose or mechanical condition. Grand Prize winner must have proof of a valid U.S. driver’s license from his/her state or place of residence in the United States to take delivery of Scooter; failure to show same may result in prize forfeiture and selection of an alternate winner. Winner will be responsible for all optional equipment, title, license, insurance and registration fees required in claiming the Scooter, applicable taxes, as well as, all other expenses relating to the receipt and use of Scooter, including any travel and transportation costs associated with collecting the Scooter. All other costs not specifically stated herein as being awarded are the responsibility of the winner. No cash alternative, substitution or transfer of prize permitted, except that Sponsor reserves the right to substitute a prize with another prize of equal or greater value if announced prize becomes unavailable.  Allow 6-8 weeks after validation for arrangement for delivery of prize.  No changes or substitutions.  Prize Winner is responsible for all taxes on prize and for all costs not specifically listed above.  If any prize becomes unavailable, Sponsor may award substitute of equal or greater value.  All federal, state and local taxes for receipt of any prize are sole responsibilities of Winner.  Odds of winning depend on number of entries received.  No substitution or transfer of prizes, except with Sponsor’s permission or where required by law.  If prize winner is a minor under applicable state law, prize may be awarded in name of parent or legal guardian. 

 

5.         General Conditions:  By entering, you agree to release, discharge, indemnify and hold harmless AT&T Mobility, Sonic Boom, Inc. and their respective affiliated and parent companies, advertising and promotion agencies, employees, officers, directors, shareholders and agents from all claims or damages arising out of your participation in this promotion and/or acceptance, ownership or use of any prize.  If for any reason any electronic portion of the promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or other causes which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, Sponsor reserves the right at its sole discretion, to cancel, terminate, modify or suspend the promotion, to disqualify any individual who tampers with any entry process, and to award prizes among eligible entries not affected by the problem.  In case of any dispute regarding identity of person submitting an electronic entry, the entry will be deemed submitted by the natural person who is the authorized holder of the transmitting email address or text messaging device/service at the time of entry.  No responsibility is assumed for any error, omission, interruption, deletion, defect, delay in operation or transmission, busy signals, communication network failure, theft or destruction or unauthorized access to, or alteration of entries; or any problems or technical malfunctions of any wireless or wired telephone network, computer online systems, servers, or providers, computer equipment, software; or failure of any entry to be received on account of technical problems or traffic congestion on any telephone or internet connection, or any combination thereof, including any injury or damage to your or any other person’s computer related to or resulting from participation in or downloading any materials from this promotion.
